Whiplash Injuries in Children
The Office for National Statistics has released figures that show that approximately 30% of all road traffic accidents involve children under the age of 10.
Although whiplash is often considered to be an injury associated with adults, research by the Spine Research Institute of San Diego suggests that children are more susceptible to whiplash because of their in-car habits and their physiology. Children are inclined to fall asleep in a car, allowing their heads to drop forward and even slump under the restraint itself. In the event of a rear-impact collision, either of these positions can increase the likelihood of sustaining a whiplash injury.
What Happens To A Child In An Impact
During a rear-impact collision, the head follows the motion of the vehicle before being flung back in the opposite direction, mimicking the action of a whip. This action extends the vertebrae beyond their normal range of motion and often at unnatural speeds. During this motion, the soft tissues surrounding the neck, shoulders and spine can be stretched, torn and bruised. Because a child’s head is proportionally larger to its body than that of an adult, children are more vulnerable to whiplash injuries.
Making a Child's Whiplash Claim
In genuine cases of whiplash, the families of young children who have sustained an injury should seek advice from a personal injury law specialist as soon as possible. If the lawyer finds there is sufficient evidence to support a claim, they will approach the insurer of the policyholder who was at fault or responsible for the collision. You may be required to provide information about the accident, such as details of any witnesses or pictures of injuries.
You will be making a claim on the behalf of your child – this is completely your own decision and is not necessarily vital. From the date of your child’s 18th birthday they will have 3 years within which to make a whiplash claim themselves. However, it is worth noting that claiming on behalf of your child immediately following the accident is more likely to lead to a successful outcome.
Failing to act quickly may decrease the amount of compensation the child is eligible for due to the fact that any injuries that have been sustained are likely to get better over time.
Making a whiplash claim is a very simple proess and the compensation amount that your child will receive will depend on the severity of their whiplash injury. Because whiplash is a soft tissue injury, it can vary hugely from person to person.
