Head Injury Claims Questions

Head Injury Claims Questions

We understand that deciding whether to pursue a head injury compensation claim and if so with which company can be very difficult. Using our extensive experience of head injury claims we have put together some of the most frequently asked questions to help you make your decision.

Q. How long do I have to make a claim for compensation?

Usually a claim must be made to a Court within three years of the date of the accident that caused the head injury. However, special rules apply in the cases of children (who can claim up to three years after their 18th birthday) or someone whose injury is so severe that they are incapacitated (in which case they can claim anytime up to three years from the date that they recover capacity to handle their affairs).

Q. Can I claim on behalf of someone who has died?

Yes. If a member of your family has died as a result of a head injury you may well be able to make a claim on their behalf. It is important to obtain specialist legal advice as soon as possible. Your 1stClaims head injury solicitor will explain this process to you and represent your interests at the inquest. This is a very specialist area of law and it is important you use a solicitor with experience and expertise. All 1stClaims solicitors have expertise in this area of injury claims.

Q. Will claiming cost me anything?

1stClaims does not charge you for using our service and all initial enquiries with our Solicitors are also free of charge, so rest assured, this initial step of making an enquiry will not cost you anything.

Once one of our Solicitors has assessed the merits of your enquiry they will make a judgement on the likely chances of bringing a successful claim and if the prospects are good, they will normally offer to take your case on a No Win No Fee basis. NOTE: If your case is successful your Solicitor will deduct up to a maximum of 25% of your final settlement or compensation award as payment for their fees. You can find out more about No Win No Fee arrangements and the potential costs that can be incurred by clicking here.

Q. How much compensation will I receive?

The amount of compensation you receive will vary greatly depending upon your injury. For full details of the amount you might receive for your head injury, please see Head Injury Compensation. In addition to the claim for your injury you can also claim for any expenses you have reasonably incurred as a result of the accident. This could include prescription charges to loss of earnings, the cost of any care and assistance you now require to any special equipment you require for your house or car. Your expert head injury solicitor will help and advise you.
