With an increasing number of high profile cases of medical and clinical negligence being reported in the press, a new study entitled ‘Listen to Patients, Speak Up For a Change’ has catalogued a range of cases where poor nursing care has caused injury and insult to patients. Never has it been so important to get the patients view regarding clinical negligence, and with personal injury firms presently in the firing line from government reforms to the healthcare system in the UK, many are wondering where it will leave genuine cases of medical negligence.
The report was created by the Patients Association and covers cases where patients have been subjected to some appalling cases of clinical negligence, apparently suffering needlessly. Cases of neglect, rudeness and sometimes outright cruelty were outlined in the report. In recent years the number of high profile compensation payouts for clinical negligence have increased significantly, and with the need to save money for essential services a very important issue at the moment, many are wondering whether the NHS can afford these increasing claims of poor standards of health care in some parts of the country.
Substandard levels of healthcare claims
The report notes that while the majority of nurses work to a high standard, unfortunately there are parts of the UK where healthcare service quality is poor, and action is needed to prevent cases of clinical negligence. The burden of the payouts in compensation claims where courts find the NHS is at fault for medical negligence ultimately falls on the taxpayer, and the effects of these often high profile payouts mean that the NHS has less money to spend on important services for patients.
The Royal College of Nursing has issued comments on this report, maintaining that its members would never condone the types of behaviour outlined in the report. The College went on to state that cuts in staffing have meant some nurses were under a lot of pressure and did not have enough time to properly care for all of their patients.
Appropriate compensation needed
Nicolas Jervis, managing director of accident claims specialists 1stClaims said: “Findings like this demonstrate just how many patients and their families in the UK there are who would benefit by having adequate legal redress on their suffering. It also proves that it’s never been more important that they also get appropriate compensation to cover the costs of recovering, suffering and rehabilitation, as well as all the associated costs due to the clinical negligence.”
Compensation can be awarded to patients who have received inadequate healthcare and have suffered to the extent that they will need financial compensation to cover the costs of getting better.
