Medical Negligence Questions
We understand that deciding whether to pursue a compensation claim and if so with which company can be a really difficult issue. Using our extensive experience of clinical negligence claims we have put together some of the most commonly asked questions to help you with your decision.
Q. Will claiming cost me anything?
Your 1stclaims.co.uk solicitor will offer you a free one hour interview. This is without obligation. If you decide for what ever reason not to pursue your claim, it will not cost you a penny. At that meeting the various ways a claim can be funded will be discussed. Your 1stclaims.co.uk solicitor will always consider whether you have the benefit of legal expense insurance or are entitled to legal aid. Sometimes you may be required to make a contribution to your legal aid. If you are going to have to pay any fees your 1stclaims.co.uk solicitor will discuss this with you in length so that you are aware exactly how much you will be paying and what this is for. But remember your first interview is free and without obligation. For more information see our medical negligence costs section.
Q. What sort of compensation will I receive?
Because clinical negligence claims are so varied and complex the amount of damages you could receive will vary greatly depending upon the circumstances. You are entitled to claim for any expenses you have reasonably incurred as a result of the accident. This could range from prescription charges to loss of earnings, from the cost of any care and assistance you now require to any special equipment you require for your house or car. Your specialist 1stclaims.co.uk clinical negligence solicitor will help and advise you.
Q. How long have I got to make a claim?
In most cases Court proceedings need to be started within three years of the negligent treatment or the time at which it would be reasonable to suspect that the treatment was negligent. Special rules apply in the cases of children and they are allowed three years from the date of their eighteenth birthday to make a claim for compensation. The important point to remember is that evidence can become stale, so the sooner you make a claim the better.
Q. Can I make a claim on behalf of someone who has died?
Yes. If a member of your family has died whilst receiving medical treatment there may be an inquest. It is important to obtain specialist legal advice as soon as possible. Your 1stclaims.co.uk solicitor will explain this process to you and represent your interests at the inquest. This is a very specialist area of law and it is important you use a solicitor with experience and expertise.
