Corporate Manslaughter Act Comes Into Force
On April 6th 2008, the new Corporate Manslaughter act comes into force and will be applicable to both private and public organisations. The act has broad implications for both employers and employees and puts greater pressure on employers to tighten up their Health and Safety policies.
The Act creates new machinery that allows organisations that are found guilty of gross negligence in the event of a person's death to be charged with corporate manslaughter (in Scotland, known as corporate homicide).
The maximum penalty for the offence is an unlimited fine plus the court can also force the company to publish details of their conviction. Senior managers are being advised to conduct a full review of their Health and Safety policy before the legislation takes effect.
