Genuine sufferers of whiplash injuries could find it harder to claim compensation and receive a whiplash payout as a result of the meteoric increase of fraudulent personal injury claims being made. Britain has one of the lowest rates of road accidents in Europe yet it also has the highest rate of personal injury claims. According to a study carried out with law firms and insurers, it is estimated that around �£5.2 million of fraudulent claims go undetected every day. This is an estimated increase of 24% increase when compared with similar research carried out in 2008. In addition, 57% of lawyers interviewed said that they had noticed an increase in claimants either faking or exaggerating their injuries in order to secure higher payouts. The worry is that fraudulent whiplash claims are now reaching epidemic proportions. A report from the Transport Research Laboratory (TRL) has been hampered because the crash test dummies used in impact simulations offer inadequate results when trying to reproduce injuries of an arbitrary nature. A detailed study by the TRL has failed to establish any link between speed and whiplash, or the size and make of the car.

Unfortunately, due to these factors and the fact that whiplash is so easy to fake or exaggerate, until research produces more conclusive results honest motorists and genuine whiplash sufferers will continue to bear the brunt of others’ dishonesty. However, the reality is that most people that do claim and receive a whiplash payout are genuine. As with any claims industry, there will always be those that try it on.
