Whiplash (Not Snakes) On A Plane?

Could turbulence on your flight cause whiplash?

Whiplash is a condition most commonly associated with rear impact car collisions. However, there are other situations in which the same actions on the neck and spine can be replicated.

The symptoms of whiplash are caused by the neck and spine imitating the actions of a whip. Usually the result of a rear impact during a road traffic accident, the head is snapped first forward and then back, stretching the vertebrae and soft tissues that surround it beyond their normal range and at speeds far beyond those that the human body was designed for. The resulting symptoms can include neck and back stiffness, headaches, muscle spasms and blurred vision. Because the symptoms are related to muscle swelling and bruising, symptoms tend not to become manifest until around six to twelve hours after the impact has occurred. Pain and stiffness is usually worse the day after the impact and can continue to get worse over the following days. Cases of whiplash have been recorded where symptoms have not become manifest until weeks after the event.

Most modern cars now take steps to prevent whiplash. Airbags and headrests are now common features and restrict the movement of the head that is instrumental in causing whiplash. However, there are still forms of transport where these facilities are absent or ineffective. In July of this year, a United Airlines jet had to be diverted after it hit severe turbulence. Among the injuries, around 30 passengers complained of the symptoms of whiplash caused by the actions of fast and slow jet streams on the aeroplane. Some of the passengers who were standing received more serious injuries. Those who remained seated, and despite wearing seatbelts, were subjected to the same conditions of those in a rear impact car collision.

In general terms, air travel is a very safe and reliable form of transport. However, as with any mode of transport, accidents can happen. As the driver of a car, the victim of a rear impact collision can launch a claim against the other driver. However, if you are the victim of a personal injury whilst flying, then you will need to seek redress from the airline itself. Whilst you are a passenger, it is their duty to ensure that you reach your destination unharmed and in safety.

In sustaining an injury from a car accident, the victim usually has three years from the event in which to make a claim. However, the laws governing accidents in the air are slightly different, meaning that claimants only have two years in which to seek recompense although the time can be even shorter. In the event that you suffer an injury whilst a passenger on an airline, it is imperative that you seek legal advice as soon as possible. The laws on time limits can be complicated and in order to get your claim in motion as quickly as possible, you will need the services of an expert.

In trying to pursue a whiplash compensation claim against an airline, you will need to provide your lawyer with as much information as possible, including medical evidence, witness statements and photographs. The more information you can provide, the less likely your claim is to be left ‘up in the air’.
