Whiplash Compensation Claims - The Process
Making a claim for whiplash compensation is easy once you have found a great solicitor to represent you, and there are several key steps and processes that you and your solicitor will need to take to ensure you the money that you deserve.
1. Firstly, your solicitor will contact you to discuss your claim for whiplash compensation. They will need to gather some initial information about your accident (this should always be done in confidence), so you will be required to describe your whiplash symptoms, the accident itself, and any other damages that you may have suffered, such as damage to your car or any possessions that were in your car at the time. You might even have other injuries as well as whiplash that you need to discuss, and this is the time to do it - your solicitor needs as much information as you can give them in order to assess how much compensation your claim for whiplash is likely to receive, and continue with your claim.
2. You will need to submit to a medical assessment, to make clear the full extent of your injuries. This will be arranged by your solicitor, usually by a doctor known to them, who you will need to visit for a full check up. They will assess the severity of your whiplash, and also look at any other injuries that you may have suffered as a result of your accident. You need to do this sooner rather than later - if you wait too long to file your claim then your whiplash will have subsided and a medical assessment will not be able to prove the full extent of your injuries. Making a claim for whiplash soon after your accident is the best way to get an accurate report, and will help you to claim the full amount of compensation that you are entitled to. This report will be used to assess how much compensation you should receive, because the compensation amount is directly linked to the severity of your injuries.
3. Your solicitor will then inform the other party involved of your intention to make a claim, and they will be required to respond with an offer - if it is satisfactory then your solicitor will settle your claim, if not then your claim for whiplash compensation may go to court to be settled.
Once you have found a solicitor that you like the look of, give them a call to discuss your claim for whiplash compensation fully - they should be able to explain the process to you and answer any questions that you might have, such as how long you can expect it to take, and the amount of compensation that they think you might get. You need to make sure that you can get in touch quickly with your solicitor via phone or email if you have any further questions, and you will also be required to provide information and return documents at various points throughout your claim for whiplash - a speedy response is essential to keep your claim progressing efficiently.
