Whiplash Claims May Come Long After The Accident

One of the problems that some people may find when they are looking to place a whiplash claim is that they never experienced or noticed any problems in the immediate aftermath of the accident. If you were looking to oppose any claim being made of this nature, it is inevitable that something like this would be jumped upon as part of the defence against the claim. However, just because a victim of whiplash didn’t notice the injury right away doesn’t mean that they don’t suffer from whiplash as a result of the accident. Quite often, after an accident, a person has large amounts of adrenaline in their system, which can lead to pain from injuries being temporarily blocked out.

If a person has been involved in a car accident and they have children in the car, they are very likely to respond first of all to their children. There is a maternal or paternal instinct that can kick in for people when their children are involved and this can often give them a focus that allows them to ignore their own injuries. This is one example of a whiplash claim in which a sufferer only noticed they had whiplash some time after the incident.

It is also fair to say that there are many different severities of whiplash that a person can suffer from. There is no doubt that there are many serious levels of injury which can greatly impact on a person’s health and ability to get around but there are also lighter variations of whiplash injuries to contend with. This means that not every injury is the same and some people may just shrug off a minor whiplash injury as being a natural reaction to the jolt. In many ways, this is exactly what a whiplash injury is but people have different levels of pain thresholds and some people may be able to carry on as normal at first before the pain starts to become too much to bear.

If a whiplash injury is not properly treated, it can become sore over time and of course, there may be movements or other issues which exacerbate the injury later. Even though later injuries have played a part in a person realising the extent of their injury, it does not detract from the fact that the initial injury occurred due to an accident and this is where the whiplash claim should start from. There are many different arguments to be made about whiplash injuries but if an injury can be traced back or related to a road traffic accident, there is no reason why a whiplash claim cannot be initiated.

If the level of whiplash injury is not too severe, there should not be the option for a person to make a life changing amount of money on their whiplash claim. However, it would be hoped that a victim would be properly compensated for their injury, their inconvenience and any loss of earnings that they may have suffered as a result of being involved in an accident.
