UK Still ‘ Whiplash Capital’ of Europe

Research by the Association of British Insurers (ABI) has confirmed the UK as the ‘whiplash capital’ of Europe. According to the findings, over 75% of all personal injury claims in the UK are for whiplash - a figure far higher than for corresponding statistics in Europe. James Walton, the ABI’s assistant director of motor and liability said that; “despite the statistics, I doubt that the UK has some of the weakest necks in Europe.” With the trend for whiplash claims still continuing to soar, experts are turning their attentions to other explanations.

Whiplash claims stretch credibility

Whiplash is caused by the hyperextension of the neck and spine, usually as the result of a rear impact collision. In the first phase of the impact, the kinetic energy from the collision transfers to the car and then to the passenger, causing the head to be thrown forward at a velocity that the neck is not designed for. As a result of the velocity, the neck and spine extend beyond their normal range of motion, stretching, straining and tearing the soft tissues that surround them. In the second phase, the head flips back and, if the headrests are not positioned correctly, hyperextension can occur in this plane.

The symptoms associated with whiplash disorder can vary from mild headaches and neck pain to more severe ones, such loss of mobility in the arms, tinnitus and feelings of vertigo. The problem for medical professionals is that there are often no visible injuries to support the claim. The majority of diagnoses are made based in the victim’s testimonial. As James Walton says, whiplash is; “often difficult to diagnose, easy to fake and exaggerate.” He also went on to describe the condition as “a fraudster’s dream.”

Cash for crashes

For the motorist, the cost of fraudulent whiplash claims is an expensive one. The ABI estimates that around £74 is added to the cost of each insurance policy as a result. This is marked by the cost of policies having risen by 40% in the last year. The discrepancy between the number of victims treated and the cost of compensation is also staggering. The NHS spends around £8million in treating whiplash injuries. By comparison, the bill for insurers in payouts is closer to £2billion.

In an unprecedented move, the ABI is calling for a partnership to be formed between insurers, doctors and lawyers to crack down on those who would exploit the system, either through faking whiplash or as part of bigger ‘cash for crash’ crime rings. The partnership would seek to set out more concrete medical guidelines for the diagnosis of whiplash and to raise public awareness as to its causes. In addition, there are proposals to ensure that genuine claimants get fair compensation and increased to rehabilitation.

Until these proposals are made real, the honest motorist must continue to bear the burden of unscrupulous individuals and gangs - and the UK will continue to wear the heavy crown of the ‘whiplash capital of Europe.’
