Public Transport Whiplash

Whiplash on public transport - who’s to blame?

When the issue of whiplash is discussed, it is normally in association with car collisions or traffic accidents. In these instances it is relatively easy to apportion blame to a driver and a whiplash compensation claim can be pursued reasonably easily. But what happens if you are a passenger on public transport and you suffer a whiplash injury? Who is to blame in this situation and what can you do to make sure that your claim is honoured?

Bus Passengers At Risk Of Whiplash

Bus accidents are relatively rare in comparison to car accidents. But passengers on buses do not have the advantage of basic safety equipment such as seatbelts, so the consequences of a bus accident can be far more severe. However, who you hold responsible for any injuries you may sustain whilst a passenger on public transport may depend on who is ultimately responsible for the accident in the first place.

If the bus driver is found to be at fault, then it is the bus company’s responsibility to deal with any compensation claims that passengers may then submit. At this point it is important to gather as much evidence as you possibly can, including proof that you were actually on the bus at the time of the accident. In this case it is advisable to swap contact details with other passengers who can act as witnesses to the event and the fact that you were on the bus at the time.

Medical Evidence

The other important piece of evidence a compensation claims specialist will need to pursue a claim is medical evidence of your injuries. As soon as you are able, you need to see a GP or go to a hospital emergency centre and have any injuries checked out by a medical professional. Whiplash can be a difficult injury to substantiate, as the symptoms and effects can be very different from person to person. Even if you feel that you are fine at the time of the accident, whiplash injuries can start to become apparent between 24 and 48 hours after the event. So it is important that if you feel any of the symptoms of whiplash even a couple of days after the accident that you consult a doctor as soon as possible.

If the accident has been caused by another motorist then you are still entitled to compensation in the same way that a car passenger is entitled to claim. As any accident involving public transport is usually reported to the Police, it is important that you establish once again your presence at the scene at the time of the accident. Your compensation claims solicitor will then be able to liase with the Police to obtain the details of the driver responsible for the accident to enable you to pursue a personal injury claim.

The Same Rights As Other Road Users

Passengers on public transport have the same rights as other road users when it comes to accident claims and personal injury compensation. Because of the nature of such accidents, injuries such as whiplash are surprisingly common, so it is important to ensure that you are checked out at the scene by the emergency services in attendance to make sure that you are not suffering from more serious injuries. But once you have received the medical attention you need, your next stop should be to talk to an accident claims specialist to ensure that you receive the compensation you are entitled to.
