Families with children are often lured to the convenience of holiday parks. Most parks have on-site entertainment available to younger visitors and, often, there are funfair-style rides to go on. However, while most of us assume that these rides are safe and vetted, there are some that can prove to be little more than a real pain in the neck.
A decision has been taken at three Butlins resorts to ban visitors from using bumper cars to bump each other. At face value, this may sound like another case of ‘Health and Safety gone mad’, but the reasoning behind it is clear enough. Whiplash is a condition caused when the neck and spine are forced to hyper-extend. In simple terms, this means that the vertebrae are forced to extend beyond their usual range and at speeds that they weren’t designed for. Usually, this is the result of a rear-impact road traffic accident.
The head is thrown forward in the first phase of the collision and then snaps back, causing the spine to imitate the cracking motion of a whip. As a result, the soft tissues surrounding the neck and spine are also stretched and can even be torn. Symptoms of whiplash can range from a mild headache and neck pain to the more severe and debilitating, such as blurred vision, loss of mobility in the arms and even depression.
Dodgems are for ‘dodging’
The stance Butlins has taken is to underline the fact that dodgem cars are for dodging and not repeated impact. To this end, they have developed their own ‘Highway Code’ for the vehicles, ensuring that visitors remain safe and that Butlins is protected from personal injury whiplash claims. Their decision has thrown the potential for funfair accidents firmly into the spotlight.
In 2002, four people were taken to hospital with suspected whiplash, after a ride malfunctioned. The ‘Whirlybird’ ride, a spinning wheel, came to a sudden halt after the hydraulic systems failed. Those in lower ‘pods’ were able to climb to safety, but 15 people were left stranded 50 feet in the air for over half an hour. Of those 15, four were taken to hospital and treated for whiplash. Inspector Peter Shepherd of the Thames Valley Police explained that; “they got their injuries because the ride stopped so suddenly.”
Over vigilant, or a wise decision?
While Butlins could be accused of being over vigilant, there are cases where members of the public have sustained whiplash through using funfair rides that have been proven to be faulty. The Health and Safety Executive (HSE) has many stringent guidelines that operators, owners and inspectors of these machines must follow. In the event that it is found that these have not been adhered to, there is certainly the possibility that a victim can seek financial recompense for their injuries. This year, the HSE are reviewing their guidelines with a view to making them even stricter, to ensure the safety of the public and funfair employees.
