Fighting The Whiplash Fraudsters

According to the Association of British Insurers (ABI), there are nearly 1,200 whiplash claims made every day in the UK, earning the nation the dubious title of ‘whiplash capital of Europe.’ The insurance industry believes that a high proportion of these claims are fraudulent, but due to the nature of whiplash it is almost impossible to sort the false claims from the legitimate ones. However, a sophisticated new piece of technology may be about to change all that.

The Whiplash Injury Toolkit, or WITkit, is a tool currently under development that measures the probability of a driver or passenger suffering whiplash in a car accident.

A lie detector for whiplash?

Dubbed by many as a ‘whiplash lie director’, the WITkit is a software programme that is being developed by vehicle safety and security testers Thatcham, and a number of insurance companies. When completed, it will enable insurers to key in the details of a specific accident such as the types of vehicles involved and the speed at which they were travelling. The WITkit will then generate a reading for how likely it is that whiplash would have been suffered in the accident. This information could then be used to assess the validity of the whiplash claim.

In a press release earlier this year, the ABI highlighted the fact that 75% of UK personal injury claims are for whiplash, ‘more than elsewhere in Europe,’ at a cost of almost £ 2billion a year to the insurance industry. Many however, are sceptical about the validity of many of these claims. The ABI’s Assistant Director of Motor and Liability, James Dalton, told a conference on whiplash in May: “Despite the statistics I doubt that the UK has some of the weakest necks in Europe. Often difficult to diagnose, easy to fake and exaggerate, whiplash is a fraudster’s dream.”

The costs of these fake claims are passed on to UK motorists, and the AA has estimated that whiplash claims currently add £66 a year on top of every insurance premium.

It is hoped that the WITkit will reverse this trend, catching out those making fraudulent claims for whiplash, and deterring others from attempting to do so in future.

The problems of proving whiplash

The real problem with whiplash claims is that, because it is a soft tissue injury, there is no way to medically prove its existence or non-existence in an individual. Therefore, the WITkit will provide valuable information for insurers when dealing with whiplash claims.

However, it is still in the early testing stages, and Thatcham has estimated that it is currently effective for use on only 10% of whiplash cases. It is hoped that this will improve with human testing, but it’s important to remember that it will always be based only on a simulation created from facts reported after the accident, so can only predict the likelihood of whiplash being suffered, not the actual presence of it.

One thing the new technology does show is the insurance industry’s determination to deal with the growing problem of fraudulent whiplash claims. Those seeking to defraud insurers may well have cause to worry, but people with legitimate whiplash claims need not fear.
