A recent study by ICM Research has revealed that fraudulent whiplash claims appear to be on the increase. In the study, 253 solicitors were queried about their experiences of personal injury whiplash claims. Of this number, 57% said that they were aware of an increase in the number of fake or unsubstantiated claims that were made in the past decade.

70% of the solicitors interviews said that they believed these claims were made as an easy way to make money. 63% of the solicitors cited TV advertising for personal injury legal services as one of the key reasons people decide to make false whiplash claims. “Whiplash has become the most popular choice for the unscrupulous claimant,” comments Nicholas Jervis, managing director of injury specialists 1stClaims. “Many of the symptoms are psychological and many of the physical ones can be faked. In addition, the plethora of information available on the Internet makes a perfect resource for those considering a fraudulent claim,” he adds.
‘Whiplash’ is the term used to describe the condition caused when the soft tissue of the spine is stretched and strain after the body is thrown in a sudden, forceful jerk. The most common cause of whiplash is to the driver and passengers of a car that suffers a rear impact. Symptoms generally take from between six to 12 hours to manifest and can include neck pain and stiffness, restricted neck movement, lower back pain, dizziness, tiredness and numbness in the arms and hands. For genuine sufferers, these and the other associated symptoms can be painful at least and debilitating at worst. However, the symptoms are also nebulous enough that many have and many do try and fake them for insurance purposes.
However, those making fraudulent claims may be unaware that there are further ramifications to their decision - and that they themselves will also be affected. “The legal system exists to offer compensation to the genuine sufferers of accidents, such as car crashes,“ says Nicholas. “Those who fake symptoms in order to gain financially are not only breaking the law but, in turn, forcing up the cost of car insurance premiums for all motorists. If statistics continue to show whiplash as a major insurance liability, insurers will continue to raise the cost of insuring against this eventuality,” he adds.
While it is difficult for solicitors and even medical staff to verify the legitimacy of many whiplash claims, solicitors are now being advised to employ more rigorous investigation into anyone seeking to make a whiplash claim. Unfortunately, genuine sufferers will suffer even further as the results of actions taken by fraudsters.
