Could A Faulty Brake Light Lead To A Whiplash Injury?
For any vehicle to be considered roadworthy, it has to be in good working condition. That includes simple and often overlooked things such as checking that all lights on the vehicle are working correctly, particularly head lights, rear lights and, most importantly, stop lights. But recent research by an online car website has suggested that a total of 2.5 million vehicles in the UK could have faulty brake lights.
While this could result in the vehicle being classified as unroadworthy and the driver liable for a £60 fine and even possibly penalty points on their licence, it has more serious implications for road safety as well. Although the research shows that just under 200 accidents a year are directly attributed to faulty brake lights, a further 26,000 accidents every year are caused by a driver misjudging another motorist’s speed. This is often as a result of failing to notice that the driver in front is slowing down rapidly. An additional 364 accidents are attributed to drivers not turning on their lights at night or in poor visibility.
Check Your Brake Lights Every Week
The biggest problem is that most people do not realise that they have a brake light problem until someone else points it out to them. Motoring experts are urging motorists to include a brake light and rear light check as part of their weekly basic maintenance to ensure that their vehicle is safe.
Without sufficient warning through properly working brake lights, it can be very difficult to judge if the vehicle in front is slowing down. The result could be a rear end collision and possible injury to the driver, including whiplash. More than 1,200 compensation claims are logged every day in the UK for whiplash injuries, the vast majority of those due to rear end collisions. Considering the number of broken or faulty brake lights that have been logged by the current research, it comes as no surprise that the amount of victims suffering from whiplash injuries is on the rise.
Government data correlates the findings, with 15% of vehicle MOT failures reported to be due to faulty lights. While a slow speed collision may result in a relatively minor injury such as whiplash, at higher speeds (particularly on motorways) the consequences of a faulty brake light could be far more serious. As the nights start to draw in and conditions become more hazardous due to winter weather, experts are urging motorists to pay more attention to basic vehicle maintenance to ensure that they are not responsible for an accident.
Talk To A Solicitor
For those who have been injured in a collision, the first port of call after the medical profession is usually a solicitor to discuss compensation for any injuries sustained. The UK has the unenviable reputation of being the ‘Whiplash capital of Europe’, and this single injury costs both the insurance companies and the NHS millions of pounds every year in compensation payouts and medical treatment. Many of these accidents could be avoided by simply purchasing a £1 bulb to replace a faulty brake light. While a rear end collision may be considered to be the other driver’s responsibility, it is up to every driver to ensure that their vehicle is in roadworthy condition and is not the root cause of an accident in the first place.
