Could claiming for whiplash cost you more in future?

At present, if you suffer whiplash as a result of a car accident that wasn’t your fault you can make a claim for compensation, with very little or no risk to yourself. The ‘no win no fee’ system in the UK enables your personal injury solicitor to recover their costs from the other party if the claim is made successfully. If on the other hand you lose your claim, these costs, and any incurred by the opposing party, are usually covered by your ‘after the event’ insurance.

These factors help keep the cost of making a claim for whiplash or any other personal injury low, and helps ensure that the claimant gets to keep all of the compensation they are awarded.

The Jackson Review and what it means for whiplash claims

However, there are changes in the air, and in the future whiplash claimants might not get such a good deal. The Jackson Review, or Review of Civil Litigation Costs, was conducted by Lord Justice Jackson in 2010 and lays out a series of recommendations for the government which may directly affect the cost of personal injury claims in the future.

One of the major changes proposed by Lord Justice Jackson was that solicitors should no longer be able to recover their success fees from the losing party. The claimant will instead have to pay these, either upfront or out of the compensation they are awarded. He has also proposed that the claimant’s after the event insurance should no longer be able to be recovered from the other party if the case is won. Such insurance is essential, as it prevents the claimant from having to pay for the opposition’s legal costs if they lose.

Lord Jackson however also indicated in his report that unsuccessful claimants should only have to make a relatively small contribution to the defendant’s legal costs, except in exceptional circumstances.

One of the main aims of the proposals is to reduce the number of claims made for personal injuries each year, with whiplash claims often singled out and blamed for the rising cost of motor insurance premiums. However, critics have warned that the changes may deter those of limited financial means and who have a valid right to claim from pursuing compensation.

General damages could increase by 10%

On the upside for claimants, another change proposed by the Jackson Review is that general damages for personal injuries should be increased by 10%, while it has been suggested that a ‘costs council’ should be set up to review the fixed costs and hourly rates charged by personal injury lawyers, on an annual basis.

Some law experts are concerned however, that the poorest in society would no longer have access to compensation for injuries sustained in accidents that were not their fault.

Justice Minister Jonathan Djanogly told the BBC recently: “The new law we are proposing will mean that the mark-up for a winning claimant’s fees will be paid from claimant’s damages, not the defendant. So claimant lawyers will be firstly more cautious to take on cases, and claimants will have an interest in what they are paying their lawyer.”
