Children just as vulnerable to whiplash injuries
Children can suffer the same type of whiplash injuries in a car accident as adults, according to reports from personal injury firms. In one recent incident three children were awarded a substantial financial payout from the courts for personal injuries when their family car was rear-ended on a roundabout.
There has been a lot of controversy in the last 10 years regarding personal injury claims and the ‘hard sell’ techniques used by injury lawyers to encourage people to claim for compensation for whiplash and other injuries after an accident. This has meant car insurance prices have increased substantially as companies need to raise more money to pay for the many compensation claims. Yet the judge in this case decided that the children’s injuries were enough to justify an award for their suffering.
Invested in court funds until they are eighteen years old
The Irish court that heard the case of the children who suffered whiplash will hold the five-figure compensation sum until the claimants are 18 years old. Whiplash can affect anyone who suffers a sudden impact in a car, especially from the rear of the vehicle. The effects can be painful although in most cases temporary. Yet there have been many cases where whiplash claims are made fraudulently, or the details or circumstances of the injuries have been exaggerated.
Often whiplash claims are made through well organised groups of fraudsters who can even set up their own injury claims companies. It is considered that these criminals are costing the insurance industry millions of pounds a year, with the costs of the claims ultimately creating higher insurance costs for other motorists. It also makes life much more difficult for genuine claimants, with whiplash being regarded as an ‘easy claim’ to make.
How to make a claim for a child who suffers whiplash through a car accident
It is important to remember that children are just as vulnerable to whiplash and in genuine cases of whiplash personal injury claims the families of young children who have suffered a whiplash injury should get advice from a personal injury law specialist. If the personal injury lawyer finds there is sufficient evidence then they will approach the insurer of the policyholder who was at fault or responsible for the collision.
It’s worth considering that if a child experiences whiplash as a passenger in a car where it is the driver who is at fault, then a claim can be made against that insurer as well. After a claim is made the insurer can either agree with the parents of the child for a settlement for the suffering and any care costs associated with the personal injuries. If the insurer does not agree to a settlement then the personal injury lawyer acting for the child can take the case to court. The court will then decide whether a payout should be made.
Often personal injury lawyers will take on a case on a no win no fee basis. This means that if the case is not successful then the lawyer will not charge any fees for their work. If the case is successful then the lawyer will make their money from the court fees and not usually take any of the compensation.
