Even a Low Speed Impact Can Cause Whiplash

It would be logical to assume that impacts at lesser speeds cause lesser degrees of injury than those that take place at high speeds. While in some instances this may be true, accidents are not governed by logic and the results of a low-speed impact can have debilitating results including the most common type of injury: whiplash.

Low-speed impacts are generally defined as those that take place at speeds of 10 mph or less. Possibly the most common injury sustained at speeds of this sort is whiplash. Whiplash is an injury caused by the sudden movement of the soft tissues of the neck and spine, usually as the result of a rear impact. The condition gets its name from the whip-like action of the torso, neck and head during an impact of this sort. During an impact, the soft tissues of the neck and spine can be forced into unnatural positions and at speeds that are unnatural to the body.

The consequences of whiplash are not widely known; most people consider that it simply means a ‘sore back’. However, symptoms can include neck and shoulder pain, numbness in the fingers and toes, blurred vision, giddiness and a difficulty in swallowing. Symptoms generally manifest themselves within 24 hours of the accident, but cases of whiplash have been known to reveal themselves up to six months after an accident. More serious symptoms are entirely possible, resulting in loss of mobility of certain parts of the body.

The key to treating whiplash is speed. Once symptoms display themselves, a victim should seek medical attention as soon as possible - especially if making a personal injury claim. Part of the problem for insurers is that whiplash is one of the most commonly exaggerated or faked injuries in the insurance industry. The reason for this is that the symptoms are not obviously identifiable; in the case of a broken bone or laceration, the injury is obvious. In the case of whiplash, however, insurers have to depend on the honesty of the claimant. As a result of the number of fraudulent whiplash cases, insurers urge genuine claimants to be seen by a doctor as quickly as possible to both seek effective treatment in time and to verify that the claim is indeed genuine.

A report by the Insurance Fraud Bureau (IFB) has suggested that false whiplash claims could be costing the insurance industry around £125 million per year. Unfortunately, the burden is borne by honest motorists, who may not realise that an average of £44 of their annual fee is the result of this kind of practice. In addition, genuine claimants may find themselves subject to extra scrutiny when launching a personal injury claim for whiplash. John Beadle of the IFB estimates that the cost of dealing with a fraudulent whiplash claim “could well be around £20,000.”

Anyone involved in a low-speed rear impact is advised to gather as much information as possible. In addition to seeking medical attention, they should take note of witness details and take photographs of the vehicles involved. Unfortunately for genuine claimants, the number of fake claims means that as many details as possible should be recorded in order to help them in their cause for compensation.
