Rising number of personal injury claims pushes up insurance costs
Motoring insurance costs rose by an average of 40% in 2009, more than 10 times the Consumer Price Index measure of inflation and the largest annual rise since the AA began collecting data in 1994. Other major insurers claim that the industry is facing a ‘perfect storm’ scenario of rising legal costs, fraud and a huge jump in the number of personal injury claims for injuries such as whiplash.
However, the British Insurance Brokers Association rebuts this by saying that many companies are increasing the cost of insurance cover to recoup several years of losses in a less than perfect economic climate. They also believe that intervention from the European Union may force premiums up again.
Injuries On The Road
The single largest factor that is held responsible for the jump in premium prices is the number of compensation claims for injuries sustained on the road. It’s not just the sheer number of claims that is responsible, but also the average amount that is being claimed by victims that insurers blame for the increase. The average claim for drivers between the age of 30 and 50 is between £1,200 and £1,450 for women and men respectively. But amongst younger drivers of 17-22 (those also more likely to be involved in an accident due to inexperience) the average claim is between £2,734 and £4,473.
Genuine Victims
“Many insurers have accused drivers, particularly young drivers, of adopting a ‘let’s see how much we can get’ approach to making a personal injury claim,” comments Nicolas Jervis of personal injury claims specialists 1stClaims. “The truth is that while a few may see a whiplash claim as an easy way to earn a fast buck, the vast majority of claimants are genuine victims who have suffered a debilitating injury as a result of the actions of someone else. They have every right to claim compensation, and that amount has to reflect the severity of the injury and its impact on the victim’s life.
But with new solvency regulations due to be imposed on financial operations that require stricter capital adequacy ratios, there could be another rise in premiums on the cards for motorists. Coupled with the sharp rise in fraudulent claims, many solicitors feel that the real victims are those who pursue a legitimate claim but are treated as if they were ‘suspect’ at best.
Whiplash ‘An Easy Claim’
“Whiplash is seen as an easy claim because it has been publicised so much over the last few years,” comments Nicolas Jervis. “The truth is that genuine whiplash injuries can be extremely painful and have a major impact on the victim’s life. We’re now only just starting to discover that this so-called ‘simple’ injury could have far greater implications for long term health. Those who have suffered as a result of someone else’s inattentive driving deserve to be compensated to a level that represents the severity of those injuries, whether we’re in the middle of an economic recession or not. Blaming the fraudsters, the economy or the EU seems a little churlish when we’re talking about people who are suffering from serious injuries that ultimately, are the responsibility of someone else’s actions,” he concludes.
