Motorcycle Rider Killed In Accident Caused By Diesel Spillage Recovers Compensation
Until a recent case no one had successfully recovered compensation following any road traffic accident caused by diesel spillage where the person causing the spillage could not be found. This has now changed following a recent payment by the Motor Insurers Bureau.
The Motor Insurers’ Bureau (THE MIB)?
The MIB is the body set up to compensate the victims of uninsured and untraced drivers. If a person can establish that they had an accident as a result of someone else’s negligence, and that person was either uninsured at the time of the accident, or was unable to be traced, the MIB will settle the claim for compensation.
However, until this case on 1st November 2007 the MIB had not previously paid out if the untraced driver had caused a diesel spillage which led to an accident. In this case unfortunately the motorcyclist was killed but his family were successfully able to recover £110,000.
The Future
