Pleural Plaques
In October 2007 the House of Lords ruled that people who have developed the pleural plaques condition after exposure to asbestos at work cannot sue their employer for compensation. The pleural plaques condition indicates the exposure to asbestos but does not itself cause pain or suffering. However, there is evidence that people with pleural plaques are at a higher risk of developing mesothelioma and until October last year they could be compensated for this.
In October the House of Lords ruled that claims for compensation for pleural plaques could no longer be made as the condition itself caused no pain or suffering. However, many victims of pleural plaques claim that it is this living in fear of developing mesothelioma which itself should give rise to a claim for compensation.
There was hope this week that the Government might intervene to change the House of Lords ruling and once again allow claims for compensation to be made for pleural plaques. However, following a debate in Westminster last week, Justice Minister Bridget Prentice said that it was inappropriate to overturn a unanimous judgment of the House of Lords. She added that she was happy to hold discussions on how to help and support sufferers of pleural plaques.
