Whiplash Compensation Awards

How do your whiplash symptoms affect the amount of your compensation award?

Whiplash injury settlements are decided either by agreement between the solicitors involved in a claim, or by the court. In determining the amount of money awarded for whiplash settlements a number of factors must be considered.

Whiplash Symptoms?

If you pursue a claim for whiplash compensation you will be awarded compensation for your pain, suffering and loss of amenity (your whiplash symptoms). These are the main factors which determine the amount of your whiplash injury settlement. The pain and suffering is obviously the amount of pain you have experienced as a result of your whiplash injury. The court or solicitors will look at how long you were in pain for, and how great the pain was. In addition, they will also consider the loss of amenity, that is the impact of the whiplash on your daily life. Did it stop you playing with or picking up your children or does it still? Did it prevent you from working (for which there would be a separate claim for those losses) or did it prevent you from playing your favourite sports. All these factors are considered in deciding how much your whiplash compensation award should be.

Why It Is Important To Use The Right Company For Your Whiplash Claim

We were recently asked to help a man who had suffered a whiplash injury and had been offered £1,200 in settlement of his whiplash claim. He came to 1stClaims and asked for some expert assistance. Within 3 months he was in receipt of a cheque for just under £5,000. Make sure you choose experts to help you with your claim, choose 1stClaims.

Minor Whiplash Injuries

If you experience minor whiplash injuries (soft tissue neck injuries) and you experience only moderate symptoms, you might receive the following amount of money for a whiplash settlement:

  • £750 to £2,500 if you make a complete recovery within 1 year
  • £2,500 to £4,250 if you make a complete recovery within 2 years

Moderate Whiplash Injury Settlements

If your symptoms were more severe than minor and the period of recovery has been fairly slow resulting in pain for a number of years with the possibility of the risk of future further vulnerability, you will receive an award in the region of:

  • £4,250 to £7,750

Severe Injuries

If you have permanent symptoms which cause you ongoing pain and suffering then the amount of the award will vary greatly depending on the severity of your injury. Awards can vary from:

  • £7,750 to £13,750

Losses and Expenses

In addition to compensation for your pain and suffering, you will also receive an award for any losses and expenses. For full details about these, please see our "How Much Compensation For Whiplash" article.

Find Out Everything You Must Know About A Whiplash Claim Before Taking Any Action

Aside from the amount of compensation that you might receive there are many other very important questions that you must have answers to before you ask someone to help you. Will you have to pay for a solicitor's time immediately when you make contact with them, or can you really have free asssistance and keep all of your compensation as claimed?

I am Nicholas Jervis and for 14 years as a solicitor I helped people that had been injured in accidents to obtain treatment for their injuries and claim compensation for their pain and suffering as well as losses and expenses. For the last five years I have connected innocent accident victims with expert whiplash claim solicitors. With nearly 20 years experience I have heard many of these questions (and a lot more) and I have prepared a guide that will answer them for you so that you do not have to worry or feel apprehensive.

My guide to whiplash claims is designed to explain your options to you and to help you to make an informed decision about who to help you with your whiplash claim; I hope that you will find it practical and informative. Thank you.
