Injured At Work, Can I Sue?

Can I make a claim for compensation against my employer if I have been injured at work?

If you have suffered an injury in the workplace due to somebody else's negligence then, yes, you may be entitled to make a claim for work accident compensation. Accidents at work can have a far-reaching effect on the injured party as often they require time off work to attend medical appointment - or even a need to take time off on a long term basis - which can have financial consequences.

Reasons to sue my employer for personal injury compensation

Accidents in the workplace happen for a number of different reasons, under varying circumstances and with varying consequences. Common workplace accidents include injuries caused by faulty machinery or faulty office equipment, slips or trips on debris or spillages on the floor of the workplace, factory accidents, warehouse accidents, accidents in hospitals, accidents involving fork lift trucks, driving accidents and scaffolding accidents.

Establishing negligence against your employer

In order to pursue a successful claim you need to be able to show that your employer has been negligent. Your employer has a duty to keep you safe and free from harm whilst in the workplace and if they breach this duty of care then you may be able to prove that they have been negligent. As soon as you become aware that you may have a work accident claim you should instruct an expert personal injury solicitor who specialises in work accident claims. The solicitor will be able to advise whether or not you have a claim worthy of pursuing.

How long do I have to make a claim?

If you have been injured in an accident at work, and are over 18 at the time of the accident, you have three years from the date of the accident in which to pursue a claim. If your claim has not settled, or if court proceedings have not been issued, by the third anniversary of the accident, you will be prevented in law from making a claim. If you were under the age of 18 at the time of the accident, the three year time limit starts from the date of your 18th birthday. You therefore have until your 21st birthday in which to make a claim.
