Scaffolding Accident

Our client was involved in an accident at work. He was pushing a skip into position and in the process slipped on a scaffolding bar which had been left in an unsafe position. They investigated the circumstances of the accident and felt sure there was a genuine claim to be made. However, on contacting our client's employers they denied that the accident was their fault.
Our solicitors made an application through the courts for the employers to send the paperwork to them that they felt sure would prove they were at fault. The application was successful and the employers then admitted liability. Our client received £3500 in total settlement of his claim including £2,700 for his pain and suffering.
Accident in Safe Door

Mrs T was kneeling down placing her employers takings in the safe located on the floor. A colleague walked into the office distracting her and causing her to turn round and let go of the safe door. The safe door swung shut trapping her thumb causing a crush injury to the thumb and debridement of the thumb nail.
This was a very complex case in proving liability. Initially Mrs T's employers insurers denied liability for the accident. There were ongoing negotiations regarding contributory negligence on the part of the client. An application was made to the court for pre-action disclosure which confirmed that no risk assessment had been carried out by the employer and that no procedure or training had been implemented regarding the correct use of the safe. Eventually after much toing and froing and serving supporting case law liability was conceded by the insurers on a 100% basis.
Mrs T had surgery carried out to repair her nail and nail bed. She has a permanent altered sensation at the tip of her thumb and intermittent mild discomfort for 3 - 4 years although this has not affected its function.
Mrs T also incurred expenses for travel, care and assistance with housework, travel expenses for a carer, medication costs and other incidental expenses. She recovered £4,300 in compensation and because she asked 1stClaims to help her find a solicitor she was able to keep all of this compensation
